It is important to know your rights as a home owner or renter.


The following eviction law may not be up to date and is NOT to be taken as legal advice. The following information is paraphrased from the eviction code provided by Fayette County Justice of the Peace Court.


SERVING NOTICE REQUIRES:


  • 72 Hours To Vacate notice may be provided if payment is not received by late due date specified on lease
  • Personal delivery should be made to anyone living in the home or RV that is 16 years of age or older.
  • Notice must be affixed to inside of door
  • This notice must also be mailed by registered/certified mail


WHEN FILING EVICTION WITH COURT – THE FOLLOWING MUST BE PROVIDED BY LANDLORD:


  • A copy of the lease (if there is one)
  • A copy of the notice to vacate
  • $141.00 filing fee for eviction


STOPPING EVICTION PROCESS:


  • Payment for rent may never be accepted after eviction is filed. Otherwise, this may interrupt the eviction from proceeding. If tenant is able to pay due rent and other applicable costs, tenant should request options that may be available for eviction suit filed directly with court.
